Temporary Residence and Work Permit in Montenegro: How the Process Really Works

The legal framework is one thing, but administrative practice is another — here, we explain the difference.

WHAT DOES THE PROCESS REALLY LOOK LIKE IN PRACTICE?

The legal framework is one thing, but the actual sequence of steps is another. In practice, most problems do not arise from missing documents, but from poor timing or choosing the wrong legal basis for residence. That is why it is important to understand what happens from the moment you enter Montenegro. Precisely because of the differences between the law and real administrative practice, most foreigners rely on local professional support throughout this process.

Administrative procedures depend on more factors than those explicitly stated in the law.

FIRST STEPS AFTER ENTERING MONTENEGRO

When a foreign national enters Montenegro, before any further administrative procedures, short-term stay must be properly regulated. In practice, this means registering the place of stay and paying the required residence (tourist) tax. This step is often underestimated, but it is essential, as it forms the basis for all subsequent procedures.

After that, most foreigners choose to engage an accounting or consulting agency to guide them through the process of company formation and the selection of the most stable legal basis for residence. At this stage, the key decisions are made—decisions that later directly affect the outcome of the application.

Documentation – What Is Typically Required

For submitting an application for temporary residence and work, the basic documentation varies depending on the legal basis, but in practice it most often includes:
– proof of education (diploma),
– a criminal record certificate from the home country (obtained through the competent authorities or diplomatic and consular missions),
– proof of accommodation (e.g., a lease agreement),
– proof of lawful stay in Montenegro (including payment of the residence/tourist tax).

If residence is being applied for on the basis of employment, an employment contract or another document clearly defining the work engagement with the company must also be submitted.

“In practice, even when the documentation is formally complete, additional clarifications or supplementary documents may still be requested.”

WHERE DO APPLICATIONS MOST OFTEN GET REJECTED?

For company founders and directors, rejections most often do not occur because of “paperwork,” but due to inconsistencies in practice.

The most common reasons include:
• unpaid tax obligations and company contributions,
• missing the deadline for extending the residence permit (the application must be submitted no later than 30 days before the current permit expires),
• staying in Montenegro without a properly registered residence and without paying the residence (tourist) tax.

These situations often happen unintentionally, but they can have serious consequences for further stay and legal status.

WHY IS IT IMPORTANT TO PROPERLY DEFINE THE BASIS FOR RESIDENCE?

Today, it is no longer enough to simply “open a company.” Institutions assess the logic of the entire structure: whether the company is operating, whether the foreign national’s role is clear and justified, and whether all previous steps have been completed in the correct order. That is why planning from the very beginning is crucial.

Proper preparation of the documentation often determines the course and duration of the procedure.
